End User License Agreement (EULA)

This End User License Agreement ("Agreement") is a binding agreement between you ("End User" or "you") and OrbitNest Inc. ("Company") for the Lingo Peach mobile application ("Application"). By downloading, installing, or using the Application, you agree to be bound by the terms of this Agreement.

Subject to the terms of this Agreement, Company grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the Application for your personal, non-commercial use on a single mobile device that you own or control.

Lingo Peach offers auto-renewable subscription services with the following terms:

• Monthly Subscription: $9.99 per month, automatically renewed every month
• Annual Subscription: $79.99 per year, automatically renewed every year
• Subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage and cancel your subscriptions by going to your account settings on the App Store after purchase
• Any unused portion of a free trial period will be forfeited when you purchase a subscription

Premium subscription includes:

• All 7 AI personality modes for conversation practice
• Unlimited voice conversation sessions
• Advanced progress analytics and skill breakdowns
• Complete CEFR assessment suite (A1-B2)
• Priority AI response times
• Offline vocabulary flashcard access
• Ad-free experience
• Early access to new features and content

Payment will be charged to your iTunes Account or Google Play account at confirmation of purchase. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.

You may cancel your subscription at any time by turning off auto-renewal through your device's app store settings. This must be done at least 24 hours before the end of the current subscription period to avoid being charged. Your subscription will remain active until the end of the current billing period.

All sales are final. Refunds are handled exclusively through the respective app store (Apple App Store or Google Play Store) according to their refund policies. Company does not provide refunds for any purchases made through the Application.

You agree not to:

• Copy, distribute, or modify the Application
• Reverse engineer, decompile, or disassemble the Application
• Use the Application for any unlawful purpose
• Share your account credentials with others
• Attempt to gain unauthorized access to our systems
• Use automated scripts or bots with the Application
• Record or redistribute AI-generated conversation content

Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the Application, to understand our practices regarding the collection, use, and disclosure of your personal information.

THE APPLICATION IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. COMPANY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. AI-GENERATED CONTENT AND LANGUAGE CORRECTIONS ARE PROVIDED FOR EDUCATIONAL PURPOSES AND MAY CONTAIN ERRORS.

IN NO EVENT SHALL COMPANY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE APPLICATION.
